NEW YORK - A Manhattan judge said Tuesday that 101 X-rated bookstores, movie theaters, and topless bars may stay open until after he hears arguments in mid-December on whether the city's new adult-entertainment zoning rules are constitutional.

The city was prepared to shutter the sex-oriented establishments Friday, when the new rules go into effect, but state Supreme Court Justice Louis B. York said the places could stay open pending his decision.

The city was about to enforce an amendment to the 1995 60-40 rule, which said an adult establishment could use only 40 percent of its space for sex-oriented materials unless it was in a specially zoned section of the city.

The amendment would have caused all but about 35 adult businesses - sex-oriented establishmentsin parts of the city zoned for adult entertainment - to close.

Mark Alonso, a lawyer for one of the strip clubs, said the businesses are complying with the law and the city is upset because the law didn't close them down.
